Site User Agreement

Your use of any of Extended Stay America’s websites (this “Site”) is governed by the following terms and conditions. Your use of this Site constitutes an agreement between you and ESH Hospitality Strategies, LLC.  and its affiliates, subsidiaries and related companies (collectively, “Extended Stay America”, “we”, “us” or “our”) and your acceptance of our Privacy and Security Statement (Click Here for Privacy and Security Statement).

PLEASE REVIEW THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS SITE. BY USING, VIEWING, OR OTHERWISE UTILIZING THIS SITE, THE SERVICES OR FUNCTIONS OFFERED IN OR BY THIS SITE AND/OR THE CONTENTS OF THIS SITE IN ANY WAY, YOU AGREE TO EACH AND ALL OF THE TERMS AND CONDITIONS SET FORTH BELOW. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, PLEASE IMMEDIATELY DISCONTINUE USE OF AND LEAVE THIS SITE. IF YOU ARE NOT EIGHTEEN (18) YEARS OF AGE OR OLDER OR ARE OTHERWISE INCAPABLE OF ENTERING INTO A LEGALLY BINDING AGREEMENT, PLEASE IMMEDIATELY DISCONTINUE USE OF AND LEAVE THIS SITE.

Extended Stay America may, at any time, in its sole discretion, modify, add, or remove all or portions of these terms and conditions without notice and, unless otherwise indicated, such changes will be effective immediately; therefore, please check these terms periodically for changes. Your continued use of this Site following any changes to these terms and conditions shall be deemed acceptance of any such changes. Please print and retain a copy of these terms and conditions for your records.

Fees And Other Charges

Your nightly rate may include a mandatory, non-governmental fee, called a Mandatory Enhanced Services Fee. The Mandatory Enhanced Services Fee is used to offset the hotel’s technology costs and expenses in order to achieve and maintain the level of technology sought by the brand and our guests, including premium cable, and covers free domestic local and long distance calling, free linen exchange, and early check in (12:00 PM) and late check-out (12:00 PM) (each by request and based on availability). Your nightly rate may also include certain mandatory, non-government fees, including, but not limited to, a State-Cost Recovery Fee, a TID Assessment Fund fee, a State Tourism Assessment fee or other similar types of fees, depending on various jurisdictional costs, fees and assessments. This category of mandatory fees are fees that are collected by the hotel to offset certain assessments that benefit tourism, infrastructure and the overall market where the hotel is located, including offsets to the cost of the County’s Tourism Improvement District Assessments, which are paid by the hotel(s), and further including offsets for franchise taxes.

Additionally, during your stay you may engage in certain activities that are subject to the imposition of fees, including, but not limited to, phone call fees, smoking fees, pet fees, late payment fees (Select Suites locations only), early check-in fees, and late check out fees (collectively generally referred to as “Other Fees”).

Further, during your stay you may elect to purchase certain amenities or services that that are subject to additional charges, including but not limited to, WiFi upgrades (based on availability), dishware/cookware purchases (Select Suites locations only), and linen exchange fees/charges (Select Suites locations only).

Questions regarding specific fees and other charges applicable to your reservation should be directed to your destination hotel.

The above-mentioned Other Fees may include, for example:

  • Phone calls: $1.00 per call. If you choose to use the in-room phone for calls other than to 911, other guest rooms, or the front desk, a charge per call shall apply upon dialing.
  • Smoking fees: Not to exceed $250.00 per incident. The hotel policy is smoking in non-smoking rooms is not allowed and smoking is only allowed in dedicated smoking rooms or designated outside smoking areas on the premises. If you violate the smoking policy, there will be a charge.
  • Pet fees: Not to exceed a $25.00 per day cleaning fee plus tax, for the first six (6) nights, per pet. Each day thereafter there is a pet cleaning fee not to exceed a $15.00 per day plus tax, per pet. If your reservation is for six (6) days or less, the pet fees for your entire stay will be due at check-in. For reservations for seven (7) days or more, the first seven (7) nights’ pet fees will be due at check-in and each seven (7) days thereafter until the end of your reservation. If you exercise your option to bring a pet to the hotel that meets the hotel requirements, you will incur fees related to that pet. Guest will be held responsible for any damage caused by or liability arising from his/her pet to any person, guest room or other area of the hotel. Payment of the pet cleaning fees does not relieve the guest of this responsibility.
  • Late payment fees (Select Suites locations only): When a guest’s folio balance exceeds a certain amount, a daily late fee as provided at check-in (as may be modified by applicable laws). Payment(s) to the hotel is/are due at specific dates and times described at check-in or thereafter. If you fail to adhere to those payment dates and times there will be a charge.
  • Early check-in fee: The hotel has a posted check-in time. If you arrive early and wish to check in early, and the hotel can accommodate your request, early check-in fees apply and will be charged to you.
    • Guests checking in before 3:00 p.m. local hotel time will be charged a fee as described below, based on available rooms:
      • Prior to 7:00 am local hotel time: Full previous day’s room and tax and any applicable mandatory fees, at Best Available Rate (BAR), as found on the hotel’s (minimum of $50.00).
      • Between 7:00 a.m. – 12:00 p.m. local hotel time: $10.00 per hour plus any applicable tax.
      • Between 12:00 p.m. – 3:00 p.m. local hotel time: Free if the hotel can accommodate.
  • Late check-out fee: The hotel has a posted checkout time. If you fail to check out by the stated time on the date you are to depart per your reservation, the hotel will charge you late check-out fees.
    • Guests checking out after 11:00 a.m. local hotel time will be charged a fee as described below:
      • After 11:00 a.m. local time, $10.00 per hour plus applicable tax, up to $50.00 plus applicable tax.
      • After 4:00 p.m. local time: A full day’s room, tax and any applicable Other Fees, at BAR, as found on hotel’s website, will be assessed.
  • Wi-fi upgrades: $1.99 per hour, $5.99 per day, $22.99 per week, or $31.99 per month plus applicable tax. If the hotel offers a WiFi upgrade option and you choose that option, there is a fee related to same that will vary based on the length of time you elect for the upgrade to apply—hourly, daily, weekly, or monthly.
  • Dishware costs (Select Suites locations only): $19.99 plus applicable tax. If you choose to use hotel offered dishware rather than your own dishware (beverage glass, mug, soup bowl, salad plate, dinner spoon, dinner knife), there will be a one-time fee per visit to purchase the dishware.
  • Cookware costs (Select Suites locations only): $39.99 plus applicable tax. If you choose to use hotel offered cookware rather than your own cookware (2-quart sauce pan with lid, an 8-inch non-stick fry pan, serving spoon, spatula, and a can opener), there will a one-time fee per visit to purchase the cookware.
  • Linen exchange (Select Suites locations only): $1.75 per day plus applicable tax. If you would like to exchange sheets and towels in between your normal housekeeping services, a charge applies.

Payment Policy

It is the policy and practice of Extended Stay America to require payment in advance for guest rooms. At check-in, guests paying the nightly rate will be charged for their entire stay. Guests paying the weekly rate will be charged for the first week of their stay upon check-in. For stays longer than seven days, guests will be required to pay for each week in advance.

Incidental Costs/Credit Card Hold

During your stay you may be required to secure an initial deposit of up to $250 with the hotel for incidental charges incurred during the stay. The entirety of, or remaining balance of this deposit will be returned or released after check-out.  Note that any unused credit card/debit card authorizations will typically be released within 5-14 business days, depending on your financial institution. Refunds of cash over $100 may be mailed by check within 14 days of departure. Policies vary by hotel; for details, please contact the hotel directly.  

Checking In

Check-in time for arriving guests begins at 3:00 p.m. local hotel time. Your reservation is guaranteed for arrival up to 6:00 p.m. local hotel time on date of arrival. Please contact your destination hotel should your travel plans require a check-in past 6:00 p.m. local hotel time on the date of arrival. Check-out time for departing guests is 11:00 a.m. local hotel time. For guests staying fewer than 7 nights, a valid credit card is required for payment.

Cancellation Policy

Advance Purchase (AP) reservations are not cancellable except within 24 hours of the original booking. Cancelling your AP reservation more than 24 hours after the original time of booking, or failing to check-in on the date of arrival in your reservation, will forfeit the full amount (including tax) of your nonrefundable advance prepayment. Cancelling your Extended Plus Program (EPP) reservation more than 24 hours after the original time of booking, or failing to check-in on the arrival date in your EPP reservation, will forfeit the nonrefundable deposit equal to three nights’ room rate and tax. Similar rules may apply to certain other special rates. Cancellation policies for reservations other than AP or EPP reservations vary by hotel.  To confirm the cancellation policy, please review the hotel’s policies page or contact the hotel directly. If you cancel such a reservation after the designated time, or fail to check in on that date, the first night’s stay (at quoted rate plus tax) will be charged as a No Show Fee to the credit card holding the reservation. General Policies

a.  Hours of Operation

  • Extended Stay America Premier Suites: Open 24 hours a day, seven days a week.
  • Extended Stay America Suites: Open 24 hours a day, seven days a week (hours may vary; please check with location).
  • Extended Stay America Select Suites: Monday-Friday from 9 a.m. - 10 p.m. Saturday-Sunday from 10 a.m. - 6 p.m. (hours may vary; please check with location).

b.  Business Services

Our front desk can assist you with mail delivery and fax and copy service should you need it; charges may apply.

c.  Housekeeping Service**

Our promise is to provide you with a fresh, clean room. We also take our commitment to the environment very seriously and strive to freshen up without wasting our natural resources unnecessarily. Towards this common goal, housekeeping services are scheduled based on the number of nights you will be staying with us. Additional full or refresh services are available as outlined below.

Extended Stay America Premier Suites

  • For stays of one to seven (1-7) nights: Fresh towels and linens are available at the front desk as often as needed.
  • For stays of eight (8+) or more nights: One Full Service housekeeping is provided each week. Full service includes: dusting, vacuuming, changing linens and towels, emptying trash, cleaning of bathroom and kitchen, and replenishing soap and toilet paper if needed. Please refer to the key packet you receive at check-in for your scheduled housekeeping service day.

Extended Stay America Suites and Extended Stay America Select Suites

  • For stays of one to seven (1-7) nights: Fresh towels and linens are available at the front desk as often as needed.
  • For stays of eight (8+) or more nights: One Full Service housekeeping is provided every two weeks. Full service includes: dusting, vacuuming, changing linens and towels, emptying trash, cleaning of bathroom and kitchen, and replenishing soap and toilet paper if needed. Please refer to the key packet you receive at check-in for your scheduled housekeeping service day.

Additional Housekeeping Options For Purchase

  • Full Service: You may purchase an additional Full Service cleaning for $10 per cleaning. Full service includes: dusting, vacuuming, changing linens and towels, emptying trash, cleaning of bathroom and kitchen, and replenishing soap and toilet paper if needed.
  • Refresh Service: You may purchase a Refresh Service for $5 per service. Refresh service includes: replacing soiled towels, emptying trash, making bed with existing linens, and replenishing soap and toilet paper if needed.

**Dishes are not washed during any housekeeping service. Some services may be limited based on location and brand; please talk to the front desk for more details.

Pet Policy

A maximum of two pets are allowed in each suite. Height and length restrictions apply-- pets can be no longer than 36 inches and no taller than 36 inches. Larger animals or more than two pets requires property manager’s approval. Please contact the property for questions.

There will be up to a $25 (+ tax) per day non-refundable cleaning fee for the first six (6) nights, per pet. Each day thereafter there is a pet cleaning fee not to exceed $15 non-refundable fee (+tax) per day, per pet. This fee is to cover the cost of cleaning guest room. If your reservation is for six (6) days or less, the pet fees for your entire stay will be due at check-in. For reservations for seven (7) days or more, the first seven (7) nights’ pet fees will be due at check-in and each seven (7) days thereafter until the end of your reservation.  Service animals will be exempt from this charge. Pet fee is subject to change.

Coupons, Promotions, And Offers

On occasion, we provide online coupons and special promotions to users of this site. Advertised prices are per standard room type based upon single occupancy. Rates do not include taxes or incidental charges. Minimum stay may be required.  Unless otherwise specified, only one promotion discount per thirty days can be used by the same guest at the same hotel location.  Rates are subject to availability and location and may be changed without notice. Additional restrictions and blackout dates may apply.

Code Of Conduct

As a condition to your use of the Site, you agree to follow our Code of Conduct, set out below. Under this Code, you will not:

  • Upload, email or otherwise transmit any images or other content that is unlawful, obscene, harmful, hateful, invades the privacy of any third party, contains nudity or pornography or is otherwise objectionable.
  • Disseminate materials that impact or invade the privacy of others, such as photographs, video clips, sound recordings, personally identifiable information, or other materials that reveal personal, private or sensitive information about another person, without that person's consent.
  • Submit material that is intentionally false, defamatory, unlawfully threatening or unlawfully harassing.
  • Infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy. Electronic materials – such as music, videos, games, images and text in electronic form – can easily be copied, modified and sent over networks (such as the internet). These electronic materials are thus extremely vulnerable to unauthorized distribution and copyright infringement. These materials may not be transmitted over the Site without the copyright owner's permission or without a legitimate "fair use" justification for the transmittal.
  • Transmit materials that contain any viruses, Trojan horses, worms, time bombs, cancelbots or other computer-programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information.
  • Use the Site to artificially generate traffic or page links to a website or for any other purpose not expressly allowed under these Terms.
  • Use the Site in a manner that could disable, overburden or impair the Site or interfere with any other party's use and enjoyment of the Site, such as through sending "spam." 
  • Use the Site to test or reverse engineer the Site in order to find limitations, vulnerabilities or to evade filtering capabilities.
  • Seek to obtain access to any materials or information through "hacking", "data harvesting" or through other means we have not intentionally made available to you through the Site.
  • Use the Site for any purpose that is unlawful or prohibited by these Terms. For example, you will not use the Site to violate any law, statute or regulation (including, without limitation, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising).

Personal And Noncommercial Use Limitation

The Site is for your personal, noncommercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, artwork, text, video, audio, pictures, content, trademarks, trade dress and other intellectual property, or any products or services found on, or obtained from, this Site

Use Of The Web Site

You agree that the Site is available only to individuals and entities that can form legally binding contracts under applicable law. Without limiting the foregoing, the Site and the services offered by the Site are not available to minors. If you do not qualify, you may not use the Site. You warrant that you are eighteen (18) years of age or older to reserve a room on this Site.

You also agree that you are legally authorized to make the travel reservations and/or purchases for either yourself or for another person for whom you are authorized to act. You may only use this Site to make legitimate reservations or purchases and shall not use this Site for any other purposes, including without limitation, to make any speculative, false or fraudulent reservations, or any reservation in anticipation of demand.

You also warrant that all information supplied by you or members of your household in using this Site is true and accurate.. You understand that overuse or abuse of the reservation facilities of this Site may result in your being denied access to such facilities. For any reservations or other services for which fees may be charged, you agree to abide by the terms or conditions of purchase imposed, including, but not limited to, payment of all amounts when due and compliance with all rules and restrictions regarding availability of rates, products, or services. You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of this Site and you guarantee the accuracy of any information you provide in relation thereto, including any payment information.

Some rates have special eligibility requirements such as Extended Perks, auto club or seniors membership. It is your responsibility to verify that you qualify for the rate that you have booked. hotels are not obligated to honor rates if you do not qualify.

Limitation On Liability

EXTENDED STAY AMERICA SHALL NOT BE LIABLE FOR ANY LOST PROFITS, COST OF COVER, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, RELIANCE, CONSEQUENTIAL OR PUNITIVE DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THIS SITE OR THE SERVICES OR FUNCTIONS OF THIS SITE OR ARISING OUT OF YOUR ACCESS TO, OR INABILITY TO ACCESS, THIS SITE OR YOUR RELIANCE UPON THIS SITE OR THE SERVICES, CONTENT OR MATERIALS IN, OR FUNCTIONS OF, THIS SITE, PROVISION OF, OR FAILURE TO PROVIDE SERVICES, OR INFORMATION, OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA, OR PROFITS, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND ON ANY THEORY OF LIABILITY (INCLUDING NEGLIGENCE), TO THE FULLEST EXTENT PERMITTED BY LAW. EXTENDED STAY AMERICA HAS NO DUTY TO UPDATE THIS SITE OR THE CONTENTS THEREOF AT ANY TIME OR FOR ANY REASON. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING AND USING THIS SITE.

WE RESERVE THE RIGHT TO CANCEL OR MODIFY RESERVATIONS WHERE IT APPEARS THAT A CUSTOMER HAS ENGAGED IN FRAUDULENT OR INAPPROPRIATE ACTIVITY OR UNDER OTHER CIRCUMSTANCES WHERE IT APPEARS THAT THE RESERVATIONS CONTAIN OR RESULTED FROM A MISTAKE OR ERROR.

Indemnification

You hereby agree to indemnify, defend and hold us, our parent companies and affiliates and their subsidiaries, and each of our and their owners, partners, members, affiliates, and each of such person's or entities' officers, directors, agents, contractors, subcontractors, guests, residents, visitors, licensees, invitees, and employees (collectively, the "Indemnified Parties") harmless from and against any and all allegations, demands, claims, liabilities, damages, fines, penalties or costs of whatsoever nature (including reasonable attorneys' fees) loss of or damage to any property or otherwise ("Claims") arising out of or in any way connected with these Terms and Conditions/Site User Agreement (except as and to the extent prohibited by applicable law) or Claims arising from your account, including, without limitation, any Claims related to infringement by you of the intellectual property rights of any person, including without limitation, copyright, patent, trade secret, trade mark, artist rights, privacy, publicity or rights under other intellectual property laws. In the event that any Claim is made or any action or proceeding is brought against the Indemnified Parties, or any of them, arising out of or connected with this agreement, any such Indemnified Party may, by reasonable notice to you, require you, at your expense, to resist such Claim or take over the defense of any such action or proceeding and employ counsel for such purpose, such counsel to be subject to the prior written approval of such Indemnified Party, which approval shall be deemed to have been given hereby in the case of counsel acting for your insurance underwriters engaged in such resistance or defense. You shall cooperate with us in the defense of any Claim. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.

Registration / Passwords

If, at any time, Extended Stay America requires registration in order to access or use any areas or information at this Site, you agree to: (1) provide true, complete, accurate and current data, as requested in the registration process (the "Registration Data"); (2) maintain and update the Registration Data promptly as required herein; (3) prevent unauthorized access or use by you or others by using your user identification number and/or passwords; (4) promptly report any unauthorized use or disclosure of your password or other breach of any Site security; and (5) not assign or transfer (or attempt to do the same) any rights granted to you under this Agreement. Extended Stay America reserves the right to suspend, and/or to refuse any further, access or use of any Site or information, if Extended Stay America learns or reasonably suspects that your Registration Data is false or inaccurate, if you refuse to provide complete and updated registration information, or you misuse or permit another to use your password who is not authorized to do so.

This Site may contain hyperlinks to websites owned or operated by parties other than Extended Stay America. Such hyperlinks are provided for your convenience only, and the inclusion of any such hyperlink does not imply endorsement by Extended Stay America of the linked websites or any association by Extended Stay America with the owners or operators of such websites. No Unlawful Or Prohibited Use

As a condition of your use of this Site, you warrant to Extended Stay America that you will not use this Site for any purpose that is unlawful or otherwise prohibited by these terms, conditions, and notices.

Copyright And Trademark Notices

All materials contained in this Site are the copyrighted property of ESH Strategies Branding LLC, its affiliates, subsidiaries, related companies and/or third party licensors. No material from this Site or any Internet site owned, operated, licensed, or controlled by us or any of these parties may be copied, reproduced, republished, uploaded, posted, transmitted, scraped or distributed in any way without our express prior express written consent. All trademarks, service marks, trade names, trade dress and logos are proprietary. You may not use any of the trademarks, logos, or other proprietary information (including images, text, page layout, or form) without our prior express written consent. We value our trademarks and take infringement of them seriously.

Travel Agent Commission

10% commission is paid for up to the first seven (7) nights only. Commission is paid 30 days following the date of room consumption and the hotel’s receipt of full payment. Contact the General Manager at the destination hotel for commission issues.

GENERAL

These terms shall be governed in all respects by the laws of the State of North Carolina without giving effect to its conflicts of law provisions. Both parties submit to the personal jurisdiction of and venue in the state and federal courts in the State of North Carolina located in Charlotte, Mecklenburg County, North Carolina.  The parties further agree that any cause of action arising under these terms shall exclusively be brought in such courts. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe, or describe the scope or extent of such section. Extended Stay America’s failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. This agreement and the terms and conditions contained herein set forth the entire understanding and agreement between Extended Stay America and you with respect to the subject matter hereof and supersede any prior or contemporaneous understanding, whether written or oral.
